Booking Terms and Conditions

Please read our Booking Terms and Conditions below.

By confirming a booking with Matthew Garrett, you agree to the following Terms and Conditions.

For the purposes of these Terms, “the Artiste” refers to Matthew Garrett, and “the Client” refers to the person, company or organisation making the booking.

Booking Confirmation

A booking is confirmed once it has been accepted by the Artiste in writing. Where a deposit is requested, the booking remains provisional until the deposit has been received and cleared.

The booking deposit forms part of the agreed fee and will be deducted from the final balance payable. Unless otherwise agreed, provisional dates will be held for a maximum of 7 days.

Fees and Payment

The agreed fee will be confirmed in writing.

Unless otherwise stated in the booking confirmation, a £100 booking deposit is payable at the time of booking, with the remaining balance due no later than 7 days before the event. Where payment by cash on the day has been agreed in advance, payment must be made prior to the start of the performance.

Corporate clients requiring alternative payment terms must agree these in advance.

Performance

The Client must ensure that the Artiste has reasonable access to the venue and that the performance can take place safely.

The Artiste reserves the right to refuse or stop a performance if there is a genuine concern regarding safety, abusive behaviour, illegal activity or unreasonable working conditions.

Where possible, every effort will be made to continue the performance once the issue has been resolved.

Insurance

The Artiste holds Public Liability Insurance with an indemnity limit of £10 million.

The Client agrees not to require the Artiste to undertake any activity that would fall outside the scope of this insurance cover.

Bad Weather and Outdoor Events

Where a performance is booked to take place outdoors, the Client must provide a suitable indoor alternative or covered performance area in the event of unsuitable weather.

Mild weather conditions, including light rain, wind or light snow, shall not automatically cancel the booking, provided the performance can take place safely and without risk of damage to equipment, props or costume.

In the event of heavy rain, strong wind, icy conditions, extreme heat, or any weather conditions which the Artiste reasonably considers unsafe or unsuitable, the Artiste may require the performance to be moved indoors or to another suitable covered area.

If no suitable alternative area is provided, the booking shall still be payable in full, provided the Artiste has attended or was ready and willing to perform.

Cancellation by the Client

If the Client cancels the booking:

  • More than 12 months before the event: No additional cancellation fee is payable. Any booking deposit already paid is non-refundable.
  • Between 12 months and 6 months before the event: 33% of the agreed fee is payable (inclusive of any booking deposit already paid).
  • Between 6 months and 1 month before the event: 50% of the agreed fee is payable (inclusive of any booking deposit already paid).
  • Within 1 month of the event: 100% of the agreed fee is payable (inclusive of any booking deposit already paid).

The cancellation charges above are intended to reflect the losses reasonably likely to arise from the cancellation, including the loss of the reserved event date and the reduced opportunity to secure alternative work as the event date approaches.

The Artiste will take reasonable steps to mitigate any loss by accepting suitable alternative work for the cancelled date where possible. If alternative work is secured for the same date, the cancellation charge will be reduced where appropriate so that the Artiste does not recover more than the loss reasonably suffered as a result of the cancellation.

Notice of cancellation must be given directly by the Client to the Artiste and must be acknowledged by the Artiste in writing before the cancellation is accepted. Cancellation cannot be made by answerphone message or via a third party.

Changes to the Booking

Any request by the Client to change the event date, venue, agreed performance times, duration or agreed services is subject to the Artiste's availability and agreement.

No change is confirmed unless and until it has been accepted by the Artiste in writing. The Artiste is under no obligation to accept a requested change where it cannot reasonably be accommodated, including where it conflicts with another booking or commitment, involves significant additional travel, or materially alters the nature of the original booking.

If a requested change cannot be agreed, the original booking will remain in place. If the Client subsequently chooses not to proceed with the original booking, this will be treated as a cancellation by the Client and the Cancellation by the Client provisions above will apply.

Reasonable adjustments to performance times may be agreed subject to availability and existing commitments. Material changes to the date, venue, timings, duration or agreed services may result in an adjustment to the agreed fee, which will be confirmed before the change is accepted.

Cancellation by the Artiste

If the Artiste cancels the booking, any fees already paid will be refunded in full.

Where reasonably possible, the Artiste will assist by recommending a suitable replacement entertainer.

Force Majeure

Neither party shall be liable for failure to perform their obligations where such failure is caused by circumstances beyond their reasonable control which make it impossible or unlawful for the event or performance to proceed as agreed. This may include, but is not limited to, severe weather, fire, flood, war, terrorism, government restrictions, or serious illness or accident which makes performance of the booking impossible.

For the avoidance of doubt, illness, accident, changes in personal circumstances, financial difficulties, changes of plans or a decision by the Client not to proceed with the event will not in themselves constitute a force majeure event. Where the event or performance remains reasonably capable of proceeding, the Client's cancellation will be dealt with under the Cancellation by the Client provisions of these Terms.

Where a genuine force majeure event prevents the booking from proceeding, both parties will first seek, where reasonably possible, to rearrange the booking to a mutually convenient alternative date, subject to the Artiste's availability.

If the booking cannot reasonably be rearranged and cannot proceed as a result of a genuine force majeure event, any payments made by the Client in respect of services which cannot be provided will be refunded.

Late Payment

The Client agrees that it is their responsibility to pay the Artiste by the agreed due date.

Any overdue payments may incur statutory late payment compensation and statutory interest where applicable.

Photography and Video

The Artiste may use photographs or video taken during the event for promotional purposes unless the Client notifies the Artiste in writing before the event that permission is not given.

Liability

The Artiste’s liability shall be limited to the total fee paid for the booking, except where liability cannot legally be excluded.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, subject to any mandatory rights the Client may have under applicable consumer law.
